That sounds more like it. I'll accept having to replace it in 3-4 years... the desert is hell on batteries after all. If it can't go ~36 months regardless of environmental conditions... then the wrong battery design was selected by the manufacturer and should be remedied by the same.
Yep that was my take as well.. regardless of mode it was somewhat lifeless... until it hit the "magic spot" - then tons of power (somewhat unexpectedly IMO). Drive mode would change where the magic spot was located... but it still was more like a switch and less like a smooth analog control...

Yep, same with mine... I drove a few long runs with it on and then took it to the dealership for clearing (re-registering it basically). I'd already been told that with some on their lot it took more than 8hrs for the charge computer to signal the OK and let it be registered... mine took barely...
Which unfortunately, is likely to result in settlements around the same $125.00 I got when the "accelerator recalls" debacle tanked the value of my IS350... despite not being directly affected by the problem. I guess if you took that $125 to a tuner along with a case of beer... you'd get closer...
