You won't prevail. You modded the car in such a way that the engine had to work outside its safe parameters set by the manufacturer. Your mod caused it to do so. Case closed.

It makes perfect sense. CAI pushes more air into the engine, if the fueling can't keep up, there will be too much oxygen particles per fuel particles and that'll lean out the car.
My STI couldn't accept an intake without tuning for it. If you had a downpipe too, you needed to upgrade injectors...

Warranty claims can be denied because of modifications.

I Googled which port BMW ships cars from, I knew the departure date, Googled which shipping companies BMW uses, found one ship that left that port, that date, going to Newark.
After a bunch of Googling I think I found the vessel carrying my car. She left Bremerhaven on July 31st, quick stop in Southampton, now she's off to Baltimore, and then finally to Newark to arrive August 16th. So with a bit of luck, I'll have my car before the month is out!
Yes. They'll say that's the reason it broke. And an intake is not a "simple" mod anymore. It used to be before MAF's and the like. But nowadays intakes are very sensitive to engine performance. For instance on my 2015 STI you had to tune for one. Couldn't just slap it on. At the same time stock...
I didn't mean it like that lol. I just meant I'm used to engines with bad reliability. But the B58 isn't one of them. Rotaries and EJ's blew left and right bone stock. I haven't heard of any B58's going stock. As far as reliability down the line, it's way too early to tell.
I went into the dealer in February, gave them money, they put the order in and now it's somewhere on the Atlantic lol. I think they're all allocated by now so you'll have to call dealers and see who has one available.
