The CF edition charged a premium over the regular version. So ya Toyota owes him a part. OEM one was also a bolted on.

If the spoiler was meant to come with the car. I'd expect Toyota to make it right to. If the 45th anniversary was missing its wing people would be demanding it to.

I'm 99% sure it's a TRD version. It replaces the OEM black. Aimgain one doesn't and just attaches on.

I would see if the rear spoiler is drilled into the boot. If it is than high chances it's the real TRD kit. I haven't seen the TRD side skirts sold individually though.

It's the latch that you disengage to adjust wheel position. And no it's not safe to have it disengage while driving.
