That's not the case. He should have given it back much earlier, meaning he would have suffered being the follow car. I understand your point, but it's only applicable if Max had been made to give the place back in the 30 seconds after Charles passed him and before he pitted.
Here's what should have happened, Max made that illegal pass, his team tells him to give it back ASAP. They didn't do that and instead waited for the stewards to review it and see if they would even penalize Max. Then when there was a safety car, that should have given the stewards or race director long enough to review the incident and told Max to give the place back before the restart. But again they were not timely enough and because Max was a bit further down the road from Charles, they just gave him the 5 second penalty. Which is standard practice.
So to me, the issue is two fold. Firstly, the review should have been a lot quicker for something so obvious. Secondly, when it takes too long and giving back the spot isn't possible (typically this is due to the driver being too far ahead or having another car between them), a review should be made on how big of a penalty it should be.
I don't blame RB for waiting for a decision, and I don't blame the race director on the decision, just in the timing of said decision.
