HP isn't the factor here, it's torque.
I've been running 490ft/lb+ on my manual for a few months without issue, however I drive it with some mechanical sympathy and an eye on not abusing the clutch.
Whilst waiting for my unit to be repaired by Akrapovic I'm going to re-fit the stock rear silencer, however the actuator has gone back with the Akrapovic unit.
Will I get any codes/errors running without the valve actuator? If so I assume I can just nuke it out with BM3?

I think there is certainly an element of that, as a rule the Japanese manufacturers seem less inclined to game the system. I also suspect that Toyota has deliberately restricted the sale numbers, as they have with the GR Yaris & GR86 to drive demand and pricing.

That's around 470ft/lb, at the moment I'm running over 490ft/lb and haven't encountered any issues. (yet!)
However, I do drive it with eye on being kind to the clutch.
If the dealer is settling direct with Toyota FS then I'd let them keep the car while it's going through - less grief.
I did the same when I returned an RX450HL early, no issues at all.
I had similar woes with BMW, so don't think you would have escaped either way!

I find 1st & 2nd are great if you are slowly cruising or absolutely nailing it... in the middle of those two extremes is where it becomes difficult.
My gut feeling is that it's nothing to do with CDV and more to do with how the engine accelerates and holds/loses revs in the mid range - changing...
My plan is to add some stripes in the same shade as the calipers/rear supra badge.
