Proof? No. But I can definitely tell you that getting rid of the CDV has pretty much eliminated instances where I find the clutch slipping when I'm not expecting it because the CDV basically moved the bite point.

I installed one of these today and it's a night and day difference, particularly on heel-toe downshifts where you have to be quick with the clutch to catch the engine revs at the right spot. Before I felt like I had forgotten how to heel-toe. Now it's very natural.

Perhaps BMW/Toyota are under the understanding that this feature is not allowed by regulation in AU. If you set the parking brake, then try to drive away in first gear and it doesn't release, then the feature is not active.

Give it a shot with the last bulleted list I posted and see if you can't replicate it 100% of the time.
I believe that it can be replicated 100% of the time if you do the following, in order:
Engine running, transmission in neutral.
Set parking brake.
Hold clutch pedal in.
Touch brake pedal and release.
Touch throttle pedal and release.
Wait ten seconds or so.
Release clutch pedal.

Every manual vehicle I've owned up until now (all nine of them) have not rolled away on me. They all had/have fully mechanical parking brakes. My Tacoma could give less of a shit what gear I'm in and how I hold the clutch, if you set that parking brake it's not...

I guess my muscle memory is to hold the clutch in, set the parking brake, turn off the car, then let the clutch out (in gear) when parking normally.
