Engineers don't usually complicate designs with frivolous parts, along with the hardware to attach them. They are pressed for time and resources as it is LOL.
Keep the part unless you have already done something to the car that makes it unnecessary (roll cage, etc).

There are instances where ECUs die and someone has to get a new one to replace. I don't see how that can be illegal or not pass smog. That would be nuts.
