With stock the exhaust flap opens when the car is warmed up and in sport mode. It's closed in comfort except it will crack open slightly on overrun. The MHD feature just allows you to open and close it at will, not based on Sport mode/OEM programming.

This has happened to me at the track as well. I've gotten used to it now but it's definitely weird and I agree that removing the CDV would probably fix it. I'll probably eventually remove it, but it really doesn't bother me in normal driving.
The catless pipes are using trickery (an O2 defouler) to not cause a CEL, the catted pipes don't use that as they are trying to fall within the expected sensor readings to not throw a CEL
